It doesn't necessarily mean it's already on the disc, it could be in a mandatory update so you have the costumes on file when you face someone online wearing them.

Personally, I'd complain about being charged that much for alternate costumes PERIOD, on the disc or not.

It's not on the disc. If i play someone online and they are using an alt costume I can't see it unless i've downloaded that pack as well.

Plus we're talking like $0.60 a character here

When you buy a game, you're not buying the content on the disc; you're only purchasing a limited license to access specific, agreed-upon content. There's all kinds of data on game discs that we don't have access to as consumers, and always has been.

Would you rather a developer just withheld that data from the final release of a game and just turned around and charged you for it as DLC a few months down the road? It's faster and easier (and potentially cheaper) for everyone if the data's already there. So long as it's not essential to playing the game, why would it matter?

For some reason, people have a hard time understanding how this works. No matter what anyone says, according to the law, we consumers do not own the content on a disc. We are just granted a license to access it.

And, now, with console companies charging publishers fees for download bandwidth, prices for DLC will stay high and go even higher. It makes economic sense (for consumers and for devs and publishers) to put as much content on a disc as possible, even unfinished stuff that needs additional development time. Slap a small file on there down the road (at a reasonable price) to make it usable, polished, and presentable. Keeps costs lower for everyone, makes the process take a lot less time, and keeps game-makers in business. Everyone wins.

We gamers are shooting ourselves in the foot by complaining about this. Seriously.

Martez and confidenceman are right. Just because something is "on the disc" doesn't mean you're entitled to it. One example I pointed out in an another thread is Windows Vista - every disc of Vista, from Home Basic to Ultimate, is the same. The installer just installs whatever one you paid for. Just because you bought the Home Basic doesn't mean you're entitled to Ultimate "because its on the disc you paid for".

You're paying for what the publisher says you paid for, no more no less.

This debate started with the RE5 DLC, and I think Gordon's point on the show (our podcast, THE HUD on iTUNES) wasn't that it was a legal issue, but that it was a bit underhanded by Capcom. I think we can all agree that legally extra content gets put on a disc that you have to pay to unlock all the time. However, what if the Killzone 2 original "versus" multiplayer maps were extra paid content that was already on the disc? And even if it was advertised as that, would everyone be so quick to jump to the developers side with that? I doubt it. There'd be a pretty huge uproar, I'm sure. Well, that's why I can understand the case for RE5's extra disc content being a cheap move, as it's all just multi-player stuff. And with this business model, Capcom didn't think to offer this content out of the goodness of their hearts for fans of the game, but to find a way to make even more money off their game. (With some artificial extra content.) They're just trying to jump on the DLC bandwagon, with a game series that's otherwise tough to provide additional content for. And that's what feels kinda shady, or cheap, on their part.

It's perfectly reasonable to criticize Capcom or anyone else for doing this. Obviously. I hate the costume DLC.

But criticize them for legit reasons - "they were on the disc I paid for" is not a legit reason. "They're stingy *******s leeching off their fanbase" is.

But for $5.99 each you should own BOTH!

This should drive down the crazy prices of the R-type Delta discs go for on Ebay...some people are getting $60+ up to almost $200 for unopened, brand new discs...

That wasn't Gordon's point, since he repeated made the argument that he should get everything on the disc. If it was just that Capcom's pricing sucks and the content isn't worth it, there wouldn't have been an argument to begin with.
