Called the number today to inquire about LIVE and what was up just for entertainment's sake. No where did "MAX", the automated guy have an option for "service info", so I went with the "account information" option with the understanding I just wanted to talk to a human. Incredible elevator music by the way, futuristic and a guy yelling "Can I get a witness" over and over to some techno beat. Placed on hold for half an hour.
When I got Jabreel, I told him I was having some technical problems and couldn't connect to XBOX live. I asked him what the problem was over there. In his broken english, he said the "server is busy" and they should have the problem corrected in "a few hours". He instructed me to go to xbox.com to the support tab and there is a letter from someone explaining what is up. It is the infamous Witten letter that says basically nothing. He thanked me for my patience and that he couldn't help me out any further. Just wanted to share this with you guys if you had any plans on calling and trying to find something out. I don't blame these phone reps at all even though they are damn near impossible to understand. I was just curious

Whiskey,

Thanks for sharing. I doubt the support reps are going to do anything but parrot their script. They just look on a card for the section that a customer is calling about and read the script in that section. I posted in another thread that I think MS's line about new users causing the problem is BS. I doubt we will ever find out what really is going on. I have my theories, but I don't want to speculate and have it taken further.

Hopefully, I am wrong and all will be fixed soon. Good luck with your games.

I was going to call but I figured they'd be reading from a script and to check if all my cables were plugged in... no thanks!!!!!!!!!!!!!!!!

Of course it is a tad interesting to see which country they're currently selling out US jobs to. Did y'all know they aren't allowed to tell you what country they are in?

Ok, I see you are be having problems with Live. Please double-check to make sure your disc is inserted right-side up. You being unable to access live is a clear indication that your disc is in the tray upside down :) Thank you, come again :)

You should have asked them if all of their cables were plugged in correctly.

Microsoft sued over Xbox Live outage
Irate gamers demand over $5 million in damages following slate of reported problems over holidays.

Microsoft now faces a lawsuit over recent problems with its Xbox Live online gaming service. Three Texas residents filed a lawsuit Friday on behalf of themselves and others who have had trouble connecting to Xbox Live in recent weeks.

The suit, filed in U.S. District Court in Houston, claims Microsoft's outages represent a breach of contract and negligent misrepresentation for which the software maker is liable. The suit doesn't claim specific damages, but notes the amount is in excess of $5 million.

In the suit, the plaintiffs allege that Microsoft should have known strong holiday sales would tax its servers. "Microsoft knew the increase in subscriptions would increase game-play on its servers, yet failed to provide adequate access and service to Xbox Live and its subscribers," read the filing.

Microsoft has apologized for the outage and said it would allow Xbox live subscribers to download a free game. A Microsoft representative was not immediately available for comment.

Can't play for a month, which is about $12 of your yearly Xbox live sub that you loose....and you sue for $5 million to cover yourself and other users? Does that mean if they win we all get a lame $10 check in the mail in a year that 75% of us won't bother cashing?

The only time MS listens is when they get sued. This is a good thing.

Do you think they would have done anything about the RROD errors had there not been a massive lawsuit on its way?

I think that the games and ideas are great but when the service is down for weeks, they should pony up again to its customers. Its a tough world out there for poor Microsoft. A billion dollars for them is a drop in the bucket, but they spin the marketing to make it sound like they are really stepping up!

It's actually only $4/17 a month ($50/12).

Law suit is silly. But at least it will get MS's attention I guess and maybe lead to them getting a better infrastructure in place so we don't get prolonged outages as a result of a foreseeable spike in usage!

It's always nice to hear about class-action suit attorneys finding their retirement cases.

I can't stand Max! i had to call him so many times too during my past RROD issues with 360. Thank god it's been months now, but i'm dreading that call and hearing him say, " an xbox360? GOTCHA" Actually the customer service reps are even worse!

Rep: Can you spell your name please

Me: B-I-L-L

Rep: d-a-v-i-d? David?

Me :........... No it's BILL

Rep: oh ok sorry, can i call you Mr. Bill

LOL i swear to god, i must have spent half the time of all my calls to customer service either repeating myself, spelling things out and asking them what the hell they just said. At one point i couldn't understand the person and it got to that awkward part where you already said "excuse me, what did you say" like 3 times, so instead of asking again i hung up lol.

I feel your pain, my brother. The reasoning is that they can hire 4 people for the price of one english speaking person in some part of the world where a US dollar will buy you a chicken and plow hitch. They put one guy on the phone and have the other 3 running the drive thru or pushing a mop. If there's a problem with linguistics, they put you on hold and the other guy puts his mop down and puts on a headset and the rotation continues on like this until the caller gives up. "Hello my name is Bob". "Ok Marvin tell me what your problem is". Brilliant really. If only Max could do more instead of these useless creatures...:(
