Can you sell "NOT FOR SALE" Blu-ray discs? (here or Ebay)

These have a black and white banner across the entire front of the Blu-ray
case.... sometimes covering up as much as 1/5 of the cover....

They are NOT the free Blu-ray discs that came from the 5-free-Blu-ray offers.
(these Blu-ray discs didn't come from Sony or Buena Vista)

Well... Where did they come from then? Free from the studios? I would advise against it if they have huge banners on them. The ones from the 5 free rebate are yours to do with what you please with since they are yours. Returning them to a store for full credit when you didn't purchase them there is dishonest and frowned upon. But selling them privately, on ebay, or turning them in used for store credit is perfectly legal and honest.

I think the better question to ask is what rules are they breaking by selling them? Fed, State or Local laws? Or, studio rules? Or, ebay rules? All of those have different consequences, if the governing body decides to pursue the matter.


An example would be breaking street dates:
Is it illegal to break street dates and buy titles before the assigned release date? No state, local or federal laws are broken by the seller or buyer. Can the studios fine or penalize the seller...yes.

I actually hit this issue when I tried to sell the Dolby Demonstration Blu-ray disc on eBay (their demo disc from CEDIA/CES). eBay cancelled the auction, stating that the copyright holder (Dolby) had reported the item as a "copyright infringement"... Now, this is a disc that Dolby handed to me at a trade show for free. I believe their rationale is that they have received license to the demo material - with the condition that it's not for sale - without having to pay royalties to all the folks involved. But if people start selling the discs, Dolby itself is probably in trouble with the studios (not me).

I thought it was pretty crappy of them, but wasn't going to push the issue... I did talk to them last week at CES, and the person in the booth was surprised about that.

Ebay is like an online garage sale, so if you have a garage sale and just because that says "not for sale", you're violating the law? I think you can go ahead and sell it on ebay.

I sold stuff that had labels saying "Not for Resale". I had no problems so far. They're mainly videogames

Gamestop takes games that have that label. I imagine it is legal practice if a company that large does it.

I've seen many copies of the free Talladega Nights Blu-Ray for sale at EB games, so go for it.
