Harmony 360: Can't control Xbox360 DVD playback or play games?

I recently got the Harmony 360 but have been struggling with getting the hard buttons (A,B,X,Y) to work within Xbox360 playback or for Xbox360 games.

The buttons work fined in the Dashboard mode but once I go into DVD playback mode or playing a game (i.e. Hexic), the button don't seem to do anything anymore.

For example, during DVD playback, I have to revert to using the game controller to hit the B button to bring up the on screen menu so I can turn on closed caption.

Does anyone have these buttons working in these 2 modes?

I am not getting an answer from Logitech. They suggested I reload the firmware, which I did, not no avail.

Can someone just confirm whether you are able to use the hard buttons during DVD playback?
