Yes, that is true but the contract MIA signed said she will be the one to pay it for them. Obviously the FCC will not fine her directly.

Nothing is "obvious" in government or the legal system.

But, holding the person who actually commited the "obscenity" accountable for their actions? What a concept!

BTW, if MIA was singing from a track (and the common understanding was that she did) didn't anybody listen to the track and think there was a problem?

I heard Madge is "furious" at MIA for pulling the stunt. It took the focus of the evening off of her. No doubt MIA got more publicity for this than she ever would have gotten otherwise.

Ah, but this would require authorizing legislation that satisfies the First Amendment and creates an enforcement mechanism, which would never, ever survive court scrutiny.

There's a reason that FCC fines for indecency make no sense: they are basically unconstitutional. The FCC and "family values" organizations have just managed to find the barest sliver of legal authority that they need to prop up this ridiculous system, and because of commitment to court precedent (and the Court's systemic inability to recognize the changing technological landscape) it persists. Given the court's rationale for upholding this system, however, if someone today was able to effectively articulate to the Supreme Court the state of the television landscape, the FCC would be stripped of this power.

Perhaps the MIA case will result in the litigation that finally ends this.

Only broadcast stations are licensed by the FCC and subject to a "Notice of Apparent Liability," as these things are known. CBS got included in the mess only because they own broadcast stations that broadcast the program, not because they were the network that distributed the program.

I think the whole thing is a bit hypocritical. The networks are increasing profanity on their shows and news every year, even encouraging it, and selectively including bits for the sole reason that an obsenity was shouted. Most of the time you can make out the obscenity.

So it's ok for Steven Tyler to be obnoxious and swear a dozen times during each family-hour broadcast of American Idol broadcast; yet, a big deal is made over an extended figure at a musical half-time show? So obscenity is perfectly Ok as long as you hit the bleep button in time (and still can read lip read the word), but watch out if you don't blur out the end of a finger? Huh? Last night Leno had a "Dealing with the public" segment, where a caller dropped 4 f**k's within 30 seconds. And there was no doubt they were 4 f**ck's behind the grating bleeps because Leno had the 4 f**cks captioned.

Yeah, that was back in a more innocent time. Stern would look like a saint compared to today's shows; e.g., American Idol. Stern actually admonished his guests not to swear; today it is actually encouraged.
