The 2009-2010 Season
Broadcast 5-week fall report cards: CBS, Fox tops

Premiere week wasn't a fluke.

Five weeks into the fall season, broadcasters have managed to maintain strong ratings for an eclectic collection of new shows that drew large debut audiences. Fox's "Glee," ABC's "Modern Family," the CW's "The Vampire Diaries" and CBS' "NCIS: Los Angeles" have continued to impress, and that's but a partial list of promising newcomers.

With these freshman success stories, one might think broadcast would have climbed in the ratings overall. It hasn't. Three networks are down compared with last year -- partly because of the effect of DVRs, partly because of top-rated veteran shows losing traction and, in the case of NBC, partly because of the loss of dramas at 10 p.m. and no new breakout hits.

The report card for the fall season so far:

CBS

The pieces of its schedule have snapped into place with precision: Putting "NCIS: LA" after "NCIS" -- click. "The Big Bang Theory" with "Two and a Half Men" -- click. Pairing "The Mentalist" with "CSI" -- well, that's more of a clunk.

The network known for ratings stability is matching last fall's performance in the adult demographic while posting a slight gain in total viewers.

"The network that appears to be most successful this fall is CBS," said Bill Carroll, vp and director of programming at Katz Television. "They had a solid lineup going into the fall, and they've had success with their new shows for the most part."

But even as "The Good Wife" and "NCIS: LA" have solidified the Tuesday lineup, the most dramatic moves were from veteran shows. Monday's "Big Bang Theory" has overtaken "Two and a Half Men" as TV's highest-rated comedy, and "NCIS" unexpectedly became the most-watched drama during its seventh year. "NCIS," not "CSI," is arguably the network's premium crime drama brand.

The biggest challenge for CBS is bolstering Sunday night dramas after freshman "Three Rivers" and veteran "Cold Case" have underwhelmed. A trickier issue is Thursday flagship "CSI," which has weakened alarmingly.

"The next case for 'CSI' might be finding its missing audience, which has made 'The Mentalist' not pay off the way it should have," said John Rash, senior vp at ad agency Campbell Mithun.

Fox

The strongest network in the spring has long been weak in the fall, sometimes ranking fourth until January.

But look now: The Rupert Murdoch-owned net is up 10% in the adult demo, placing second in the ratings race long before Simon Cowell and company show up to save the day.

"They're doing better than anticipated, having become more competitive in the fourth quarter," Horizon Media's Brad Adgate said.

Not only has the net launched two scripted hits with "The Cleveland Show" and "Glee," but also they're two of the youngest-skewing new shows. Also, the move of "So You Think You Can Dance" to the fall might not have made the biggest ratings splash, but the show occasionally has bested ABC's "Dancing With the Stars" and provided "Glee" with a great lead-in. (Just wait until Fox pairs "Glee" with "American Idol.")

The network also has gained traction Thursdays by moving scripted dramas "Bones" and "Fringe" into the competitive fray -- though in the case of "Fringe," which has been getting beat up in the ratings, the move has come at a price.

The sophomore drama "Lie to Me" is squandering more of its "House" lead-in, and Fridays continue to be an evening of tax write-offs.

ABC

ABC got a raw deal this fall.

The gauge for a fall victory used to be launching one new hit.

The Alphabet has launched three shows that have stabilized with impressive numbers (and none is a spinoff thank you very much).

Two of the breakouts are comedies, a genre the network has been trying to crack for years.

Still, ABC has dropped in the adult demo nearly as much as NBC, partly because of such sagging veterans as "Dancing With the Stars" and "Desperate Housewives" and partly because of struggling newcomers including 10 p.m. dramas "Forgotten" and "Eastwick."

The Wednesday night comedy block has been put together in precisely the right order: the strongest, "Modern Family," at 9 p.m.; runner-up "Cougar Town" right after; and the weakest, "Hank," launching the night into the middling "The Middle."

"They made a very smart play on Wednesday night," said Jack MacKenzie, executive vp at Magid Associates. "When you launch that many comedies, they're not all going to work, but everything so far suggests it's going to pay off."

Also notable is "Private Practice," a one-time bubble show that's now one of ABC's top-rated dramas, beating CBS' "Mentalist" on Thursday nights.

NBC

With no breakouts and "The Jay Leno Show" trending downward, NBC is running low on rationalizations.

"Trauma" and "Mercy" have been modest performers, the cancellation of "Southland" sullied the network's reputation among writers, aging procedurals like the "Law & Order" franchise have dipped, and "Leno" has not found its ratings bottom.

"As Jay Leno goes, so goes the network," Carroll said. "Leno has been struggling. The rest of the lineup, even the returning shows, have not reached their previous levels."

"The Biggest Loser" continues to impress, and "Sunday Night Football" is a ratings driver and a vehicle to promote other shows. But those are not enough.

" 'Leno' is working for NBC accountants but not for NBC-affiliate news directors," Rash said. "Right now, the network's success is dependent on football and reality TV -- and football ends in January."

That said, the new Thursday comedy "Community" feels like a growth vehicle if one turns a blind eye to its ratings during a tough time period, and once rivals go into repeats against "Leno," NBC's year-round strategy with the talk-show host could begin paying dividends that are apparent to network outsiders.

THE CW

"Vampire Diaries," "Vampire Diaries," "Vampire Diaries."

It's impossible to overstate the importance of this Thursday night series to the CW. The network desperately needed a hit in its target demo, and "Diaries" is just the ticket, jump-starting a highly competitive slot.

The CW has been laser-focused on contemporary soaps since the success of "Gossip Girl," but it is this hybrid entry -- paranormal/fantasy drama -- that has become its breakout success. With that in mind, the network might reconsider shuttling genre series "Smallville" to Fridays this season, where the once-strong show has lost a significant portion of its ratings.

The CW also gains the most percentage-wise when DVR use is taken into consideration -- a point the network often makes and that ad buyers agree is significant.

"If you have to pick one network where you can't just look at linear ratings, it's them," Adgate said.

Fox can't be too happy with the prospect of a Game 7 pre-empting it's youthful-skewing animation block on Sundays for the older-skewing MLB Playoffs. Then again, if it happens then baseball saves Fox from showing new episodes from each of their shows which will minimize repeats down the line. I just want a game 7 so the Angels pull the upset and I can taste the bitters tears of disappointed Yankees fans (and network/Madison Ave. executives).

Averages a 4.0 in 18-49s, topping reruns on CBS

ABC won its fifth straight Thursday with ease last night, opposite a lineup of mostly reruns on CBS and Fox's surging baseball.

ABC averaged a 4.0 adults 18-49 rating and 11 share, according to Nielsen overnights, well ahead of second-place Fox's 3.3/9.

As a reminder, fast nationals measure timeslot data and not actual program data, and they do not account for time zone differences. Fox's live baseball coverage lasted past 11 p.m., and thus its numbers will likely adjust significantly when final data is released.

ABC only won one hour of the night, 9 p.m., where "Grey's Anatomy" averaged a 5.2, up 6 percent from last week's 4.9. CBS's "CSI" was a repeat that hour, as was lead-out "The Mentalist."

Fox finished first at 10 p.m. with game five of the American League Championship Series peaking with a 3.8.

The game averaged a 3.3 in primetime, up 27 percent from last year's National League Championship Series game on the same night, which averaged a 2.6.

Meanwhile, for the night, CBS placed third in primetime at 3.0/8, NBC fourth at 2.4/7, Univision fifth at 1.4/4 and CW sixth at 0.8/2.

As a reminder, all ratings are based on live-plus-same-day DVR playback. Seven-day DVR data won't be available for several weeks. Thirty-three percent of Nielsen households have DVRs.

CBS started the night in the lead with a 4.0 at 8 p.m. for Survivor. Fox was second with a 3.1 for baseball, ABC third with a 3.0 for FlashForward, NBC fourth with a 2.0 for Community (1.9) and Parks and Recreation (2.1), Univision fifth with a 1.3 for El Nombre del Amor and CW sixth with a 0.9 for a repeat of The Vampire Diaries.

ABC took the lead at 9 p.m. with a 5.2 for Grey's, while NBC moved to second with a 3.7 for The Office (4.2) and 30 Rock (3.2, up 7 percent from last week). Fox was third with a 2.9 for more baseball, CBS fourth with a 2.1 for a CSI rerun, Univision fifth with a 1.7 for Sortilegio and CW sixth with a 0.8 for a repeat of Supernatural.

At 10 p.m. Fox was first with a 3.8 for baseball, with ABC second with a 3.7 for Private Practice. CBS was third with a 2.7 for a repeat of The Mentalist, NBC fourth with a 1.6 for The Jay Leno Show and Univision fifth with a 1.1 for Rosa de Guadalupe.

ABC also led the night among households with a 7.5 average overnight rating and a 12 share. CBS was second at 7.1/12, Fox third at 6.7/11, NBC fourth at 3.7/6, Univision fifth at 1.8/3 and CW sixth at 1.4/2.

I read a review of the show, noticed by the headline that it was going to be negative and then stopped reading after the reviewer wrote that he just didn't "get" Jeff Dunham's comedy. While it might be on some interest to have someone who doesn't like the comedian to review his new show on the chance that his mind might be changed, I'd think it would make more sense to have reviewers who have a chance of enjoying the show.

Yep, as a kid, I was part of the huge cult following for Soupy. About a year ago I bought a DVD of some of his old shows.

i would think FOX wants a game 6 sunday nite (most likely a game 6 due to rain tomorrow) because all the usual sunday animation shows wouldve been reruns this week anyway & a game 6 especially with the yanks would beat reruns.

He did it again.

After breaking Comedy Central's ratings records with his special last year, ventriloquist Jeff Dunham repeated the feat on the series side.

The Thursday debut of "The Jeff Dunham Show" drew 5.3 million viewers, making it the most-watched series premiere in Comedy Central's history.

The show, mostly panned by critics, also posted all-time records for a Comedy Central series premiere in adults 18-49 (2.6 rating).

Including the same-night replays, the premiere of "Jeff Dunham" attracted 7.9 million viewers.

It was the top cable series on Thursday night and powered Comedy Central to its highest-rated night of the year.

Travel Channel Auction Heats Up
Reports: News Corp. In Lead With $800 Million To $900 Million Bid

The auction for The Travel Channel is reportedly heating up, with News Corp. vaulting into the lead with an estimated bid for the network in the $800 million to $900 million range.

That is a pretty hefty premium for the network, known mostly for its traveling foodies Anthony Bourdain of No Reservations and Adam Richman of Man v. Food, as well as less culinary-centric shows like Bridget's Sexiest Beaches.

And it far outpaces original expectations for the channel.

When Cox Communications said in June that it would hire Goldman Sachs to investigate strategic alternatives for Travel, most analysts expected it would sell for upwards of $600 million.

Pali Research media analyst Richard Greenfield estimated that Travel Channel will throw off about $50 million in cash flow in 2009, valuing an $800 million to $900 million bid at a 17 times multiple.

The Financial Times reported Oct. 22 that News Corp. was in the lead, but that other companies like Scripps Networks Interactive and a consortium led by Providence Equity Group could trump their bid.

It is expected that Travel would fit well with News Corp.'s National Geographic Channel.

While the valuation for Travel Channel harkens back to the heady days of earlier in the decade -- when Viacom paid $3 billion for BET Networks in 2000, it implied a cash flow multiple of 23 times -- it wouldn't be out of character for News Corp. to make a much higher bid to increase its chances of winning. It launched a $5.6 billion bid for Dow Jones & Co. in 2007, well above what most observers have valued the property. News Corp. closed the Dow Jones deal in January 2008.

Hip and elemental

Even though the occasion is sad, there is something oddly bracing in setting out to write about a man who called himself "Soupy." We need more Soupys in this self-important, don't-you-dare-throw-that-pie world -- and now there is one less, Soupy Sales having died Thursday at the age of 83.

Born Milton Supman to the only Jewish family in Franklinton, N.C., Sales first got into children's television in Detroit in 1953 -- he also had a grown-up nighttime show there -- but his years of greatest renown were from 1959 to 1966, when he worked out of Los Angeles and New York and was seen all over the country. His costume, such as it was, comprised a black pullover sweater and a floppy bow tie; early on he also wore a top hat, later on he ditched the tie.

My memory of "The Soupy Sales Show" (originally "Lunch with Soupy Sales") is not of specific bits, but an impression of noise and energy and a cheap, sketchy set fit with the usual appurtenances of a midcentury kids' show: a window (for Pookie the lion puppet to appear in), a door (for Soupy to answer). Waving in from the side of the frame were the paws of his otherwise unseen very big dogs, White Fang, the Biggest and Meanest Dog in the USA, and Black Tooth, the Biggest and Sweetest Dog in the USA, whom I never could keep straight in spite of the color-coding. (White Fang is the one I would imitate by saying, "Oh-reah-oh-reh-uh," unless it was Black Tooth.) There were pies in the face, mostly in Soupy's face, though sometimes in the face of a celebrity guest: Frank Sinatra took one, and so did Tony Curtis. The jokes were already old when vaudeville was new: "Show me a giant rooster chasing a member of Parliament.... And I'll show you a chicken catch a Tory." ("Now, just what do we mean by that?" Soupy said afterward, never answering the question.)

The corniness was knowing -- it was jazz, basically, like a bop musician ad-libbing on "Sweet Sue." Not so much written as riffed, "The Soupy Sales Show" was both hip and elemental, obscure and accessible, because even when it was obscure it was silly and energetic. Although the show was ostensibly for kids, the sound of laughter coming off the screen was wholly that of the grown men on the crew, to whom Soupy would play as a nightclub comic plays to the band. (That is a sound you don't hear much on TV now, the sound of the laughing crew.)

It was a musical show, driven by jazz and pop records lip-synced by Pookie and danced to by Soupy. (He put out a dance record of his own, "The Mouse": "Hey, you can do it in your house.") But there was also music in his voice, a sleepy, latent Southerness that gave his craziest passages the lilt of a lullabye. In one episode, he tells White Fang -- or is it Black Tooth? -- about the prizes at a local talent show, and it sings like poetry:

"They're givin' away a big satin pillow" -- prounced "pillah" -- "and it says 'Mother'; and they're givin' away a eight-by-ten glossy photo of the World's Fair pavilion of 1939; and they're givin' away a big apron that says on there, 'HI! I'm the chef'; and they're givin' away a Howard Johnson all-day sucker, and a eight-by-ten picture of Howard Johnson eatin' pistachio ice cream; and they're givin' away an autographed picture of Bob Steele, my favorite; and a Kay Kyser record of 'Praise the Lord and Pass the Ammunition' and also a record by Elton Britt, 'There's a Star-Spangled Banner Wavin' Somewhere.'"

It is true that children like a reassuring voice of gentle authority, but it is also true that they like to go where the wild things are. They like an adult who does not talk down to them, but they particularly like an adult who doesn't talk down to them because he is already on their level.

There is more kids' television now than ever; whole networks are devoted to it. And yet with all those hours to fill, you will find nothing like Soupy Sales. (The closest thing to him on TV nowadays is Craig Ferguson; they have a similarly free style, and like to get up close to the camera.) There is sometimes the impression of mayhem, but it is never actually spontaneous or free. They have sealed up the cracks where the Mouse gets in.

ET can confirm that Benjamin Bratt will be back on "Law & Order" in the role that garnered him an Emmy nom!

Bratt, who appeared on the show for four seasons in the '90s, will return in an upcoming episode that reunites his character Detective Reynaldo Curtis with former "boss" Lt. Anita van Buren (S. Epatha Merkerson).

"I am thrilled that Ben is coming back for a return appearance. He joined us for our recent 20th anniversary celebration and it was like he never left," says series creator and executive producer Dick Wolf.

"Law & Order" airs Fridays at 8 p.m. on NBC.
