I assume the $$$$$$$ for HD modulators is caused by patents is that so or another reason?

No, it's because of the digital nature of the products and a mix of copyright protection elements that make it difficult to produce a viable product...

The signals available to be modulated are either high definition component video, which needs to be digitized and compressed, or a high-bandwidth HDMI stream that needs to be re-encoded/compressed. Those chips aren't cheap. Patents may account for a few dollars, but it's just a complicated, low-volume product. The manufacturers aren't going to sell millions of these, either.
