"A student who ran a site which enabled the download of a million movie and TV show subtitle files has been found guilty of copyright infringement offenses. Despite it being acknowledged that the 25-year-old made no money from the three-year-old operation, prosecutors demanded a jail sentence. After struggling due to a lack of case law, in the end the court settle on a fine.

If I stole from you regularly, a large amount, and gave it away, would you not be interested in taking action against me? The fact that someone doesn't make any money from a crime doesn't mean it's not a crime. The problem is not their gain but the loss of the person stolen from. Even if you only counted every viewing of a million downloads as ten cents worth of loss, that's a hundred thousand dollars worth. If you stole a hundred thousand dollars from any other industry, do you think it would even be remotely questioned that you would end up in jail?
