I purchased the Energy Take Classic 5.1 system in January 2009 and think it is a good value at the $300 price I paid. The Monoprice 9774 set appears to have been manufactured in exactly the same place and other than very slight variances that might occur from one production run to the next, I would say the speakers are the same. The fine print in the Energy manual probably indicates "subject to change" and the differences between the Energy version and the Monoprice 9774 version could fall under that disclaimer if Energy had the same 9774 speakers for sale labeled Take Classic 5.1. This new 10565 doesn't seem to me to be nearly as similar and nobody would ever even consider making a clone claim if not for the previous 9774 speaker.
I like Monoprice and have purchased a number of products from the company over the years, I believe the Energy Take Classic 5.1 speaker design was sold to Monoprice either appropriately by the manufacturer or in violation of an exclusivity agreement, let the courts decide that issue but I would pay a little extra to get the Energy brand until that issue is clear.
Since Energy started selling this speaker design, the company was sold to Klipsch and then to Audiovox so who knows if Energy will continue to offer the Take Classic 5.1 speaker set and if the design in fact was by a Chinese equipment manufacturer, who can blame them for selling their own speaker through whatever outlet is available? I am afraid Audiovox is going to completely trash all of the Klipsch brands personally, although I hope that doesn't happen.
