So, after finding out about Monster Cables dirty tactics, I decided to post a poll to see how many others AVS members will no longer buy Monster Cable and Monster Power products.

FYI, here is what I was posting on some other forums (motorcycle forums) for those that may not know about this yet:

So, I was over at www.avsforum.com when I found out that Monster Cable has been doing some major strong-arm tactics on large and small companies that have used the word Monster in their name, product name or anything like it.

Some of the things they are sueing about:
Monster Garage
Monster House
Monster Energy Drink
Snow Monsters (a kids skiing group)
MonsterVintage (small used clothing store)
Monsters Inc.
Monster's of the Midway (Chicago Bears)
Fenway Park's Monster seats
Monster Job site

So, they are going after small and large alike. If you can't afford to fight it, they will take as little as $1000 up front and only 1% of your gross yearly business income.

I personally don't want to support a company that has business tactics like that. Trying to take away names of things that have nothing to do with their business. Please don't support them and purchase their very overpriced products.

It looks like their general counsel is looking for work to keep himself and an army of lawyers busy for years. Probably trying to justify his existence and build an empire. The term "Monsters of the Midway" has been around since before Noel Lee was in diapers.

I can see how this can cause confusion. I went into BB yesterday to buy some cables, got confused, and ended up buying the Chicago Bears !! Gotta love them lawyers !!

i have a bunch of there cables, they were found in a room in my parents hotels. they sat around for months and no one claimed them (tried calling the # given for the room, didnt exist). they might have been stolen, i dont know, but i definately took them :) even though they were free, i dont like having them, crappy companies like monster piss me off. i know a friend of mine will like them, i might give them to him in favor of something else.
suing companies because they put "monster" in the name, idiots.

I do not use their products. I do not support their products nor their suit. You can get better wire and cable and IC's for the same or less $$ many places.

It's not about wether or not they win, they have to protect their name from any perceived infringement or they lose their legal abililty to ever protect it. It may seem ridiculous, but if they don't go after everyone then they won't be able to go after anyone. Because Monster is expanding their product line so much and so quickly, they are forced by the current laws into these legal actions.

Having a law degree but never practicing, I understand the position of protecting your name. However, none of these are trying to capitalize on the "good name" of Monster Cables and it's obvious. As long as they aren't using a logo that could be confused with Monster Cables in any way, or implied relationship, there is no reason to sue IMO. Is this really true or urban myth?

A few years back Office Depot was either sued by or had some discussions with Home Depot about the use of the name Depot. Home Depot had the name first and in that case, there could be some perceived relationship. I don't know what the outcome was, but they both still use the name.

Now if you want to hear something really ridiculous and almost nauseating, I heard that Donald Trump is copyrighting the phrase "You're fired".

I've defended various Monster products on this forum from time to time in the past, despite their generally overpriced nature and occasionally dubious claims. However, with the discovery of their bizarre and unreasonable legal tactics, I'll never buy another Monster product. It's a shame, because they make a few things I'd like to try. Fortunately other companies make similar products so I'll just take my money there.

As for the rationalization that Monster is somehow forced to "protect its trademark," it's just preposterous nonsense. There is no sense in which most of these case dilute, infringe, or confuse any trademark issues. Only a moron would be confused, so perhaps that typifies the intellect of the company's leaders and legal counsel. This is of course a statement of opinion and not a statement of fact. They may only appear to be morons; in which case I'd be wrong.

Somehow Pioneer Electronics and Pioneer Hi-Bred Seed and Pioneer Press and the Sons of the Pioneers and Pioneer Builders are able to co-exist without brand dilution, trademark infringement, or product confusion. Monster's position is a mere legal pretense for greed and extortion.

What I can afford, when I can afford it...

Well, if that's the case then Monster Cable has every right to sue!!!! If someone is selling Cable and calling it "MONSTER CABLE PRODUCT", then it is definitely infringing on the copyright law.

I'd like to see the case against Disney though. I call that post an outright lie without researching, as "Monsters" is not "Monster", it is pluralized and therefore unless Monster Cable has the term "Monster's Inc" copyrighted, that case, if indeed one has been filed, won't even get to court (again, I doubt this one, if it were real CNN would have been all over it!)
