Very strange that it isn't connecting via modem, even with your own ISP. I wonder if the modem is bad. Are you sure you don't have Vonage or some other VOIP phone line such as the Comcast phone service?
Note that the modem will work for calling in PPV purchases on a VOIP line because it uses 1200/2400 baud to transfer that info but dialing into MSNTV requires a much faster connection.
My reading of the site doesn't see where it mentions the update in the stream till Sept 2008. That I think has been understood from previous discussions when 3.8 was first released. The site does mention about doing updates via dialup after Sept 15,2007 if the update hasn't taken. (Probably for those that for some reason didn't get the update during the 3.8 "roll out" in Sept 07. Not because it was/is pulled from the Sat Stream.)
Regarding Modem issues. Have you tried the "friend and family" phone line option?

I know for "High-Speed" Dialup my Grandma's or Aunt's Homes have much better phone lines so if I needed a "cleaner" line for some reason I could probably borrow their phone for a bit. If you aren't sure how "clean" your phone line(s) are you could try bypassing or removing as many "extensions" as possible. That might help resolve some issues. Best place to hook up is the NID or test jack box that connects your home to the outside line. That "bypasses" everything in the house... so you get the best possible connection from that location.
As a side note if you haven't looked in that box before... you might find a bad/dirty contact in that box can cause issues. Back in the day... By simply removing and blowing off fluff on the jack I got an improved connection speed in the house.
