Here's some "hard" evidence:
On the right side is the original and on the left side is the recorded signal from the optical output from the WDTV.
It is 1kHz sinus tone cca 20 sec log with volume steps 0dB, -1dB, -2dB, -3dB, -4dB, -5dB, -6dB

From the picture you can clearly see that the output is amplified by +1dB, which causes clipping in records with peaks over -1dB.
I've also analyzed the max. volume of a bunch of original CDs, most of them have peaks over -1dB, close to 0dB -> clipping if grabbed and played through the WDTV
