I think it's opposite of Reese not killing him , Reese killed him, as they discussed the merits of actually killing/allowing someone to die as the better good for man-kind . As Reese pointed that out to Finch that Finch was changing his position on them killing / allowing a person to die , where Finch said that now he had feeling that " Bad Code " needs to be deleted , where before Finch had abhorrently disliked the taking of any life for any reason . This was the discussion about weather to let the hit man get killed by the mob & only protect the girl as Finch wanted OR as Reese said that they should protect him as well as the hitman/boy friend was trying to protect the girl as well . That started the whole discussion on who should be protected & who should be allowed to die . Up to this point Reese abides by Finch's wishes by figuring out another way to solve a problem instead of killing the problem , but with the new opinion on who should be deleted as " Bad Code " that now came outta Finch.
Last season Reese had said more than once that someone should killed & Finch pulled Reese back from doing that .
Seems that the code of conduct on P O I is evolving after the " Root " abduction . Finch's eyes were really opened to the really bad side of human nature with all that Root had done in the Name of
" Deleting Bad Code "
I found it quite striking that Finch actually said " Bad Code " as that is what Root was calling the people that she killed & other persons who sought to control the " Machine "
