First off, the US Constitution isn't up for debate, by anyone except SCOTUS. Just because you and Obama and whomever else thinks the 4th amendment is up for negotiation, doesn't make it so. Obama never swore to defend Americans at all costs, including abridging their constitutionally guaranteed freedom from unreasonable searches, he in fact did the exact opposite. He ONLY swore to uphold the Constitution. That's it.

You are asserting the Constitution is up for debate by the President, to pick and chose which amendments and parts he will carry out and protect, and which he will undermine, at his discretion. You are wrong. There is NO leeway for the President, or anyone else in government, to actively subvert the Constitution, as many have obviously done here. It is not naive to expect people to live up to their oaths, is it? To obey the law? Whatever laws enacted the NSA's draconian dragnet known as PRISM are null and void. The President did NOT vow to defend people at all costs from terrorists, he only
vowed to defend the Constitution.
The fact that you are so flip about it and call me naive is precisely what's wrong with America : nobody cares about their constitution any more, it's all up for debate and ignoring as you see fit. So you can feel a little safer.
The fact of the matter is, the US government is WAY more dangerous than any terrorist group, and a way bigger threat to your safety and liberty than any other force. The founders were deeply distrustful about governments turning into tyrannies, building a massive database and watching everyone is only step one before they tighten the screws. First the cast the net, then they pull it in. Doesn't matter who gets caught in it, "we don't apologize".
Truth is, the head of the NSA committed purgery and is in contempt of congress when we blatantly lied to about PRISM, the very reason these programs are a secret is precisely because they would outrage the public. There are many more allegations to come out shortly, and the fact that we're even discussing them is thanks to Snowden.
Kinect is just another tool, that can be used for good or ill. I will buy it, to write games for it, but don't think for a second that the NSA can't or won't ever use it to snoop on people, they have the tech, and pay for it (actually with your tax dollars, that's the obscene part). You pay the government for the privilege to violate your 4th amendment rights to not be subjected to unwarranted spying. They DO spy on Americans on US Soil.
The ACLU had their offices bugged and had several people speaking to their lawyers unable to perform their duties because of this dragnet. They have legal standing to complain and have launched a constitutional complaint with SCOTUS. These types of programs have a huge silencing effect on democracy. It is a war on dissent and democracy, when they bug MLK, the DNC, Greenpeace, Occupy Wall Street. The US government doesn't actually have the right to do this, well, I guess we'll see what SCOTUS says, but if you believe the FUD coming out of washington about "trust us, this is only used against the bad guys", I have a bridge to sell you.
The only FUD is what's coming out of the White House and the NSA hacks who care nothing for the Constitution, neither the spirit of it nor the letter.
