Hello Mr. Barger. Frankly, I'm shocked it took him this long to show up, as I told him in several emails that this is where I had heard about him.
I'm sick to death of the whole situation at this point (and I'm guessing no one else is reading anymore either), but just to clarify a couple things ...
I received Mr. Barger's phone number from eBay only AFTER I was shown on this forum how to do so (I received the eBay email on 2/1), so I haven't had it from moment one as he claims. Since then, I have called and received no call back. He has has had MY phone since moment one, as he asked for it on 1/8 (the day payment was made) via this email, the only communication I had from him until I emailed asking where my product was ...

"Please email me your phone number for the shipping invoice..thx"

The above is the ONLY message I received from Mr. Barger prior to me contacting him about non-receipt, so I'm not sure how I was supposed to "know" when I was to receive anything. I never even got a tracking number via Pay Pal. (And, after this experience, I totally agree with "Rutger" about Pay Pal ... NEVER again.)
UPDATE: I went through my junk mail/SPAM folder tonight and did find an email dated 1/12 from Mr. Barger saying: "Your projector should arrive by Saturday," which would have been 1/13. That was the first time I'd seen that email, or I would have contacted Mr. Barger before I did. (Tracking information was NOT included and no carrier was specified.)
While I have also kept Mr. Barger's email and location information private, he has decided to post the full name and address of the DHL employee with whom we've been dealing, totally without permission. While, at the same time, telling me he filed a complaint with eBay for me sharing his (Mr. Barger's) phone number with DHL (silly, since he was the shipper and therefore involved in a transaction with the company). Mr. Barger also posted a DHL tracking number in my feedback, where he also accused me of buyer fraud, that revealed my full name, city, state and even zip code. He did this AFTER he had received MULTIPLE written communications from DHL and KNEW that information to be totally inaccurate.
I first contacted Mr. Barger, through eBay, on 1/22/07, two weeks after I had paid, since I had never received any info or my item. Prior to that, I wasn't terribly worried, as I thought it was still within a reasonable time frame. (I called DHL on the evening of 1/25 and Mr. Barger, and I, received confirmation of non-delivery on 1/29.)
After four days of back and forth (all of which did nothing but deny any responsibility to even look into it; all I was asking at the time), this is what he said ...

"DHL wont give us the time of day as we were not the shipping (manufacture shipped this) or the receiver, you. I'm truely [sic] a 3rd party in this transaction. This shipped to you from the manufacture to your door. We are only a selling company/listing agent for the distributor. If this projector was actually lost in transit, delivered to the wrong state or signed for by someone that does not live at your address, then DHL may be able to get another projector shipped under DHL insurance, but they are not going to do anything when it shows it was delivered to your confirmed shipping address and signed for by you. Maybe you will get more answers/options from them. But we have tried before and since we are not on the shipment history at all, they will not give us the time of day.. [sic]"
How very helpful (as if DHL would ship me a new projector) and completely NOT what he says in his auction item descriptions, which claim the product is in the U.S. (as someone else on this forum pointed out). He also has a Mitsubishi "HC3000" listed as a 1080p projector (from his feedback responses: "Thank you for your NEW MITSUBISHI HC3100 HDTV 1080P projector purchase AAA+++") which, to my knowledge, doesn't exist at that resolution/model number.
Basically, from moment one, his attitude was, even if you didn't get it, it's not my fault, which is just infuriating to me. (When I do sell on eBay I ship ALL my packages with tracking, be they worth $3 or $300 and if tracking shows they didn't get it, then I refund the customer's money--and I've had to do it--it's only fair. I also send that tracking info to buyers, immediately, and if an item is damaged in transit--happened twice--I call UPS and file an insurance claim, then, once they confirm they've picked up and/or inspected the item, I refund the customer in full. I don't make them wait until *I* get a check. I mean, duh, how would that be fair?)
I didn't "edit" a single email. I just didn't post every single one, and neither did Mr. Barger. He clearly said, in MULTIPLE emails: "If we win the paypal dispute, are you OK with us not wanting to work with you at all on your insurance claim? Yes or No?"
I never filed an insurance claim with DHL. I just called and said I didn't receive the package. BIG difference. In fact, I COULDN'T file an insurance claim with DHL because I AM NOT THE SHIPPER.
And, despite what he says here, he told me via email, SEVERAL TIMES, that he would NOT call DHL and confirm anything I said, because it "didn't matter ... tracking doesn't lie." He also said that 1 of of 40,000 DHL employees knew my story; again untrue, the DHL manager told him, and I, that ANY DHL employee who pulled up the shipment by tracking number would confirm to Mr. Barger what he was telling him.
I didn't file anything with Pay Pal until receiving SIX emails from Mr. Barger ALL telling me he would do nothing to help me and that he didn't believe the DHL manager's story, even AFTER Mr. Barger received a copy of the DHL airbill. I also waited until that point to post anything here. I didn't file anything with eBay, or even post negative feedback, until after Mr. Barger accused me, over and over, of "fraud" and claimed it was "extortion" (or however he spelled it) for me to expect either a replacement product or refund by 2/8--a full month after he received my payment.
This is from Pay Pal's own website (mostly for Mr. Barger's edification) ...
"What is the difference between a dispute and a claim?
"Before you can file a claim and ask PayPal to investigate a problem transaction, you must usually open a dispute. During a dispute, you are encouraged to communicate directly with your seller to work out your problem transaction.
"If you feel that you are unable to resolve the issue, you or your seller can ask PayPal to investigate by escalating to a claim. When you escalate to a claim, you are asking PayPal to investigate and decide the outcome. A dispute must be escalated to a claim within 20 of the date the dispute was opened."
I receiving NOTHING from Pay Pal for filing this dispute (not even a preliminary credit; and even now that's is a claim I still have NOTHING from Pay Pal.) and didn't "escalate" to a "claim, until AFTER Mr. Barger told me he had no intention of doing anything until or unless I dropped the Pay Pal dispute, which, even Pay Pal itself says not to do unless the matter is resolved. (Which I'm sure Mr. Barger knows well.)
From the Pay Pal website: "It's important that you wait until you are 100% satisfied that your concerns have been addressed before closing the dispute. A closed dispute cannot be re-opened or escalated to a PayPal claim."
Again, just look at Mr. Barger's reactions--what sort of idiot would expect someone, whom they have relentlessly called a "thief," a "liar" and a "fraud" to just sit around and wait until they felt like, just maybe, giving them a refund; heck, if I hadn't pushed and pushed he would never even have called DHL--and his feedback record and decide if that's someone you want to do business with. And, feel free to check mine too, I've received one negative, total, from a seller: Mr. Barger; the rest are mostly from half.com buyers from before the eBay switch over--a couple because I couldn't confirm orders once when my computer died and I had no Internet access for two-plus weeks--and two from, to make a long story short, someone I purchased counterfeit goods from via eBay years and years ago. That account was shut down by eBay, but they had many others and pretended to buy a couple of things from me so they could leave negative feedback--the feedback about non-receipt was left within seconds of the purchase being made, though you can't tell that now since, as I said, it's been YEARS and the item numbers are no longer active. I've never had a single "mutually withdrawn" feedback, which Mr. Barger does DAILY. One of my negatives is even a mis-labeled positive.
I've said all along that, after talking to DHL at length, I'm pretty certain that Mr. Barger did send the item. (Or, at least, he sent me SOMETHING.) And, again as I've previously stated ad nauseam, I understand why he was skeptical about my claims until after DHL responded.
Long story short: I never received anything from this seller, be it his fault or DHL's I must get a product to be charged for it.
At this point, Mr. Barger can add whatever he wants (frankly, in doing so, I think he's making my point about his character crystal clear). I've said my piece (and then some) and stand by each and every thing I've said here, and to Mr. Barger himself. I've told no "lies" or anything even close. I've just stated, and re-stated (thinking maybe he'd get it this time) the truth, over and over. All to no avail. Racking my brain to come up with ways to prove I didn't get the package, I sent Mr. Barger a copy of my signature. I told him I could try and talk to UPS so that he could see the signature for packages I DID sign for. I even offered to provide Mr. Barger with records from our home security company showing that my alarm was engaged and the door hadn't been opened for HOURS around the time the delivery was supposedly made. Through it all, he refused to even call DHL and inquire (if he had, he would have found out the same info I did), and just kept sending me angry, snide emails that said YOUR A LIAR [sic] and a "thief" and that he was going to "call the police" if I didn't stop emailing him. (I told him that, if he thought it would help, I'd be more than happy to speak to the police.)
And, by the way, Mr. Barger, I STILL don't have a refund. Yes, I opened a credit card dispute, but they have 60-90 days to investigate it and can re-bill my account at any time. I DO NOT have a refund at this time from you, DHL, or anyone else, and I may never. Though, if that happens, I will pursue the matter in small claims court with Mr. Barger, as it has already been confirmed to me via DHL that the insurance claim is "pending payment."
