DVD Forum's job is to create a specification. It has no commercialization activity. It is therefore up to individual companies to choose to build products based on it. And Toshiba is choosing to not do that anymore.
Put another way, some company could pick up the specs and have a go at it.
The only complication will be that there may not be a patent pool for it, so getting IP licensing may become difficult.
