DirecTV apparently got a free exclusive on satellite--at least until the free Hdnet warps into the Hdnet Entertainment channel; others must pay for it. It is expected that Hdnet's pay-TV channels will become a part of a HDTV programming package on Dish Network later this year, some time between late May and September.
The same reason Target carries brand X toilet paper and Wall mart only has brand Y.
It's business and contracts. There is no requirement for DBS companies to carry anything except some rules when it comes to local channels. And even those are conditional. If you carry a city, you must carry all it's stations. So if DTV doesn't want to carry a particular station they just have to drop the whole city or market. Dish on the other hand may choose to carry that market.
And don't expect this free market to change. Congress loves this freedom of choice and a competative market. That's why they said no the the Dish / Direct merger. You as a consumer have to study the offerings of Dish and Direct and choose which one is best for you. They both have to try and win you over.
