DTV must-carry clarification? (unencrypted QAM over cable)

I'm hoping someone (in the industry) can help me with the following questions. I've googled and searched FCC, and there doesn't seem to be a definitive answer, just bickering amongst the major parties.


1. Does the FCC mandate that MSOs (cable operators) must carry local HDTV stations in the clear, and w/o requiring a STB? The following link seems to suggest so, but has no hard dates.

2. If so, when must the MSOs implement these features by?


If anyone can provide a definitive link to the FCC mandate of must carry DTV by cable operators I'd appreciate it.

I think there are 2 differenct issues here. First a cable operator is not allowed to encrypt a digital TV signal that he provides over his system if the same channel can be received with an antenna in your area. So if you have an ATSC tuner either in your TV or a separate OTA ATSC tuner then you can obtain the local OTA channels with basic cable service.

Secondly there is the issue of what local OTA digital channels a cable operator is obligated to provide, with the exception of not currently being required to carry more than one channel from the same network I do not know which channels he has to provide and hopefully someone else will provide the information on those laws.

For most (nearly all) cable providers, you need a QAM capable card to recieve anything over cable.
