The FCC should treat the HD and regular broadcast of sports as separate events. That way if say Fox won't broadcast the SuperBowl in HD, someone else (HDNet) could without having to deal with the NTSC rights holder. If the FCC really wants to push HD this would be the way to do it. The threat of loosing viewers might push some networks towards HD (probably not Fox though).

Just and idea...

I see the point you're getting at but this really doesn't have anything to do with the FCC. It's a rights issue among the broadcast rights holders (the teams, NBA, NCAA, MLB, NFC, AFC, etc.) and the broadcasters and other program distributors like HDNet. They'd all have to renegotiate the agreements to allow what you're talking about.

If, say, HDNet wanted the rights to the Superbowl in HD-only while Fox got SD-only rights, HDNet would have to pay the rightsholders a fee and Fox would want to renegotiate the fee that they're already paying to a smaller amount due to the anticipated lost revenue that would result from the smaller audience they would attract. A real can of worms.
