i used the gt9500 (gigabyte) for over a year (now using gt240) and never got problems
i use xbmc (windows) or mpc-hc (+reclock for automatic refresh change, using displaychanger )
and the automatic refresh was always set correctly. I NEVER go to change refresh to control panel
make sure you use latest nvidia driver, latest mpc-hc and latest beta reclock
