I think he would have had a case if he weren't a "normal" person.

It's kind of David vs. Goliat.

The whole arrangement except nelly's voice is an almost 1:1 copy, don't think anyone would get away with it if it was the other way around.

That someone grabbed a Timbaland song and just put a different voice on it.

Lots of people don't clear samples all the time. It's stupid when you're famous like Timbaland though because then people will want to come after you because you're making money. It's a waste of time to go after many small-time producers who don't clear samples because you're not going to get anything out of it.


That being said, I give Timbaland a pass because Nelly Furtado is super hot and has an awesome accent.


We live in a remix-culture in all senses of the word, from fashion to music, to everything. Things get blurred, it happens. I'm not super worried about that always, IMO. It's part of the creative process, almost everything we create has referents and influences.

i totally agree with you.. there are so many artists out there that have sampled other artists' music whether they were famous or not.. and in a sense it does sound like "borrowing" but if you're not getting caught, then why stop

I have no problems whatsoever with remixes.

But doing a 1:1 copy, no permission, no credits to original composer etc. etc. that I would call stealing. Not remixing.

Also, I feel there is a difference of taking "clips" from songs and rearrange/mix/merge/whatever to make a new piece of music.

I don't think this one falls into that category.

I feel sorry for Nelly actually, because she probably had no clue about this.
